equivalent to the illegal and incompatible aid received, until
the latter aid has been recovered. In its final authorization in
July of an additional aid to the German company
"Textilwerke Deggendorf GmbH" the Commission therefore
decided that a part of this aid is suspended pending
compliance with a previous Commission decision on illegal
and incompatible aid to this company.
In Case C-313/90 CIRFS v Commission, the Court had
confirmed that the framework on aid to the synthetic fiber
sector, accepted by the Member States, creates binding legal
effects obliging Member States to notify all aid to that sector
even when given under an approved regional scheme. Later
individual decisions derogating from the framework could
not modify the framework's scope. The Commission's
decision not to initiate proceedings under Article 93(2)
against a French aid to Allied Signal was therefore annulled.
Accordingly, the Commission opened such proceedings in
respect of the aid and has now reached a final decision
requiring the reimbursement of the part of the aid found
incompatible with the common market.
A "user's guide" to procedures in state aid cases is nearing
completion. Since the beginning of the year, DG IV has
received comments from many of the Member States. All
have welcomed this initiative. The procedural rules on state
aid have never before been codified. The guide will be
published in the new edition of the collection of EC
legislation and policy statements (Volume II of the
Competition Rules), which will be out early next year.
